These Terms govern your access to and use of Pictro. By creating an account, purchasing credits, or generating a photoshoot or restoration, you agree to these conditions and to the Privacy Policy v2 (effective 2026-05-19).

This is version 2 (v2) of the Terms of Service, in force from 19 May 2026.
Key changes from v1: (a) explicit reference to Privacy Policy v2, including Brazilian data residency and the international-transfer regime for AI provider calls; (b) confirmation that accepting these Terms covers the LGPD Art. 33 V specific consent for use of AI providers outside Brazil; (c) verified reaffirmation of the "MFA mandatory on admin sensitive mutations" control, now enforced by a server-side `require_fresh_totp` gate.
The prepaid-credit pack model, bonus photos, no-cash-refund policy, and AI variability acknowledgement remain unchanged.
By accessing or using Pictro, you confirm that you are at least 18 years old and capable of entering into a binding agreement.
If you use Pictro on behalf of an organization, you represent that you have authority to bind that organization.
Acceptance of these Terms is combined with acceptance of the current Privacy Policy; both reflect the version indicated at the top of this page.
Pictro is a fully digital, AI-powered image generation and restoration service. There is no physical product, no studio session, no photographer, and no human model involved in the delivery.
All outputs — AI photoshoots and AI restorations of old photos — are digital files generated by AI models from the reference photos and instructions you provide.
The service is provided on demand and consumes prepaid credits from your account.
You must provide accurate registration information and maintain the confidentiality of your credentials.
You are responsible for all activities under your account. Notify us immediately at support@pictro.com if you suspect unauthorized access.
Administrator accounts require mandatory MFA, and sensitive admin mutations require fresh TOTP reauthentication (`require_fresh_totp` gate). These controls are enforced server-side.
Do not upload infringing, unlawful, or harmful content.
Do not attempt to reverse engineer or abuse the platform, including rate limits and AI systems.
Respect the privacy of people and third parties when uploading reference imagery. You represent that you are authorized to use any face or image you upload.
Pictro runs on prepaid credits: you purchase a credit pack and each photoshoot or restoration consumes a defined number of credits at the moment generation starts.
Pricing, pack sizes, and credit cost per operation are displayed on the purchase page before you confirm payment.
Payment is processed by Stripe; full card numbers (PAN) and CVV never reach Pictro.
Delivery is fully digital. As soon as generation completes, your images become available in your account for viewing and download. Typical delivery time is a few minutes after the run starts; during peak demand it can take longer.
The quality of the result depends directly on the quality of the photos you upload as reference: resolution, lighting, sharpness, absence of occlusions (sunglasses, masks, heavy shadows, a finger in front of the face), variety of angles and expressions, and how faithfully the photos represent your current face. Better input photos produce better and more faithful results. Low-quality photos — poorly lit, blurry, very old, heavily filtered, or shot from extreme angles — can produce less faithful results, and that does not constitute a defect of the service.
Because we acknowledge this variability that is intrinsic to AI generation, every pack already includes 2 (two) bonus photos in addition to the contracted premium photos. For example: the "8 premium photos" pack delivers 8 + 2 = 10 photos in total, and the "16 premium photos" pack delivers 16 + 2 = 18 photos in total. Those 2 bonus photos act as a quality cushion: if a few shots in the premium set do not turn out as expected, the bonus shots increase the chance that you will be satisfied with the delivered set. The bonus photos are already priced into the pack and are not refundable in cash even if the customer does not use them.
If a run stays stuck in processing for an extended period without completing any image, an automatic watchdog marks the run as failed and credits the corresponding amount back to your account — in credits, not in cash. No ticket is required.
Because delivery happens online inside your authenticated account, it is your responsibility to maintain access to your registered email and your Pictro account in order to download and keep the generated files.
General policy: Pictro does NOT issue cash refunds (monetary chargebacks) for the amount paid for credit packs, except where applicable law requires a monetary refund. When a refund is warranted under the terms below, it is issued as platform credits in your Pictro account.
Why no cash refunds: the service is digital, personalized, and generated to order from your photos and instructions. Each run consumes AI compute capacity immediately, there is no physical product, and an image already generated for you cannot be "undone". That is why the product is structured as prepaid packs with the 2-bonus-photo margin already built in — precisely to absorb the variability of the result without needing a cash refund. By purchasing, you acknowledge and accept this model.
Failure without delivery (automatic coverage): if a run fails before producing any image, the consumed credit is returned to your account automatically — in credits. No request needed.
Material defect after delivery: if a completed delivery has a clearly identifiable material defect attributable to the service (for example, a corrupted file or a file in a format or resolution other than the one purchased), our support team may grant compensatory credit after review, upon request at support@pictro.com. Results that simply did not please aesthetically — including cases where the user uploaded reference photos outside the criteria in Section 6 — do NOT qualify as a defect and do not produce a refund, precisely because the product already delivers 2 bonus photos as a margin for quality variation.
Right of withdrawal (Brazilian Consumer Code, art. 49): art. 49 of the Brazilian Consumer Protection Code (CDC) grants a 7-day right of withdrawal for purchases made outside a physical store. That right does NOT apply to this service because what is delivered is AI-generated digital imagery produced on demand from your own reference photos and your own choices — that is, content personalized to you and consumed at the moment of generation, which cannot be "returned" without total loss. In plain terms: once the AI has generated the images based on your instructions, the work has already been performed specifically for you and that delivery cannot be undone.
The non-applicability of art. 49 does not affect your rights in case of execution failure, service defect, or incorrect billing, which remain governed by the Brazilian Consumer Protection Code.
AI generation is non-deterministic: running the same photoshoot or the same restoration again produces different outputs, even with the same photos and instructions. By starting a generation you acknowledge this as an intrinsic characteristic of the service, not as a defect.
The expected quality range already accounts for the 2 bonus photos per pack (Section 6) as a margin for that variability. That is why the pack is priced and described as "X photos + 2 bonus": the bonus shots exist to absorb the weaker images of the set.
When a run fails without producing any image, you can re-run it for free: the original credit is honored and no additional credit is charged for that retry (subject to an hourly cap to prevent abuse).
When a run completes successfully and you want to generate another version, that counts as a new generation and consumes credits normally. There is no guarantee that a new run will be "better looking" than the previous one; it will simply be different. If you are not satisfied aesthetically with the result even after the 2 bonus photos already included, a new paid generation is the way to try again — there is no cash refund in that case.
You retain rights over reference photos you upload. By submitting assets, you grant Pictro a license to process them solely for service delivery.
AI-generated images are licensed to you for personal and commercial use, except where restricted by the specific style pack you chose.
Pictro trademarks, software, and documentation remain our exclusive property.
You agree not to use generated images for harassment, discrimination, deepfakes without consent, or any unlawful purpose.
We may suspend or terminate accounts engaged in misuse or harmful conduct, including any attempt to generate content that violates the policies of our AI providers.
Data handling is governed by Privacy Policy v2. This section summarizes the contract-relevant points.
Pictro production infrastructure is hosted in Brazil (GCP southamerica-east1). Account data, uploaded photos, and generated images do not leave Brazil for storage purposes.
Some AI, payment, and transactional-email calls are processed by operators outside Brazil (OpenAI, Vertex AI/Gemini, Stripe, Resend). Your acceptance of these Terms and of the Privacy Policy includes the specific LGPD Art. 33 V consent required for those transfers.
Fallback events to the external Gemini API (outside Brazil) are recorded in internal audit for Art. 33 traceability.

You may cancel your account at any time. We may terminate or suspend access if you breach these Terms or applicable laws.
Upon termination, we will delete or anonymize personal data in accordance with our Privacy Policy, except where retention is required by law.
Pictro provides services "as is" and disclaims subjective warranties about the aesthetic outcome of AI generation, to the fullest extent permitted by law.
Our total liability for any claim is limited to the amount paid for the service in the 12 months preceding the event.
We are not liable for indirect, incidental, or consequential damages.
These Terms are governed by the laws of Brazil. Parties agree to resolve disputes in São Paulo, SP, except where consumer protections mandate otherwise.

We may update these Terms to reflect product evolutions or legal changes.
We will provide prior notice through email or in-app notifications before material changes take effect; continued use after updates constitutes acceptance. The re-acceptance window for new versions is described in `docs/PRIVACY_POLICY_V2_MIGRATION.md`.
